Auction Conditions


TERMS OF SALE

1. All bids are per lot, as numbered in the catalog. The right to withdraw any lot or lots from the sale, or to group two or more lots.

2. The highest bidder shall prevail at a standard advance over the next highest bid. Should any dispute arise between bidders, the decision of the auctioneer as to the successful bidder and the re-offering or resale of the lot under dispute will rest entirely on the judgement of the auctioneer. The auctioneer will regulate the bidding and reserves the right to refuse any bid believed by him not to be made in good faith. The auctioneer will bid on behalf of clients, but will not be responsible for any errors in the execution of bidding instructions.

3. A 15% buyer's commission will be added to the hammer (selling) price of each lot and becomes part of the total purchase price.

4. Unless the sale is advertised and announced as an unrestricted sale, or a sale without reserve, consigners have reserved the right to bid personally, through the auctioneer or through any other agent.

5. Floor bidders: All bidders shall give their Name and Address to the auctioneer prior to the bidding. Payment of the entire purchase price shall be made immediately after the sale, including those lots on which opinions are desired under Term 9 of these Terms of Sale, unless special arrangements have been made.

6. Mail bidders: A successful mail bidder will be notified of the lots purchased and must remit payment before the lots are sent. Delivery to a successful mail bidder will be to the address on the bid sheet. Proof of receipt of a shipment at the advised address shall constitute delivery. Purchasers known to us or who furnish satisfactory references, may, at our opinion, have purchases forwarded for immediate payment. A minimum charge of $3.00 wil lbe made for postage, insurance and handling. All purchasers are expected to pay for the lots immediately, including those lots on which opinions are desired under Term 9 of these Terms of Sale, unless special arrangements have been made.

7. Title shall not pass to the buyer until full payment has been received by the auctioneer.

8. Successful bidders agree to pay for lots specified above and no credit is extended. A late payment charge of 1½ % per month will be imposed on overdue payments. This is 18% per year. All reasonable legal fees and/or collection charges incurred by Northland Auctions, in respect of overdue accounts will be payable by the purchaser. In the event that successful bidders to not collect and pay for lots in accordance with Terms 5 & 6 above, the lots in question may be re-offered for sale and any loss arising from such sale, including standard auction commissions will be charged to the defaulter.

9. Each lot is sold as genuine, but when in the opinion of any mutually acceptable authority the lot is declared otherwise, the purchase price will be refunded in full provided the lot is received within a period of 4 weeks from the date of auction. When an opinion is expected to take more than this 4 week period, the buyer will be granted an extention of time, provided written notification is received within 4 weeks from the sale date. All lots placed on extention must be paid in advance. No lot will be accepted back under any circumstances after six months from the auction date. Expenses incurred shall be borne by the purchaser, except where the lot is other than as described, in which case we will pay the actual cost up to a maximum of $50.00. The inability of a mutually acceptable authority to express an opinion is not grounds for the return of a lot. In the event agreement cannot be reached regarding a mutually acceptable authority, the Philatelic Foundation shall become the expertising authority.

10. Any lot, the description of which is incorrect, is returnable, burt only within 14 days of receipt. All disputed lots must be returned intact as received. The following lots may not be returned for any reason whatsoever: lots containing ten or more stamps; lots from buyers who have had the opportunity to examine them before the sale; lots described as having defects or faults may not be returned because of any faults; lots described "as is". No illustrated lots may be returned because of centering, margins, perforations or other factors shown in the illustrations.

11. New Jersey Sales Tax is payable by Purchasers subject to the tax. The 15% buyers premium has been deemed by law to be a part of the purchase price and thus is subject to sales tax as well.

12. Agents are personally responsible for all purchases made by them on behalf of their clients.

13. The placing of a bid shall constitute acceptance of the foregoing Terms of Sale.
